Ruh-Roh. The Orlando Sentinel is reporting that more than two-dozen workers at Capital Grille restaurants in three states have sued Darden Restaurants, accusing the Orlando-based company’s high-end steakhouse chain of violating federal wage laws and discriminating against minority workers. The accusers state that the chain assigns minorities less desirable jobs. They are seeking class-action status for the suit, filed in U.S. District Court in Illinois. The suit was filed by Restaurant Opportunities Centers United, a NY advocacy group for restaurant servers, cooks, and related staff.
The lawsuit alleges that workers at Capital Grille restaurants in Chicago, Washington, and NYC were required to perform prep work off the clock before and after their shifts. Darden’s tip-sharing policy is also under the gun. Their policy requires tipped workers, who are legally paid less than government-mandated minimum wage because of these tips, to share a portion of their tips with hourly workers. You know what, I would be livid too.
A rep for Darden Restaurants called the claims “baseless,” as he leaned back in his chair made of gold and wiped his nose with a diamond.
